CONDITIONS OF USE AND SALE AT SHOPMUNDO
Avacare is the trade name of Avacare, SRL., which includes the Avacarerd.com pages.
Avacare offers services within an electronic platform based on a website and a mobile application with functions enabled to carry out transactions, exchange information and details between external buyers and sellers of products and services, serving as an intermediary between both users.
This Agreement refers to Avacare., as we or the company, and to you as a user of our site, once you register, whether you are an individual (end consumer) or the authorized representative of a company.
Before proceeding, please read this agreement because by accessing, browsing or purchasing on the site you indicate that you accept all of our Terms and Conditions . In addition, you should read the Conditions of Sale of each seller separately, as they may vary according to the individual policies of each of them and their stores.
We reserve the right to change this site and modify and update these Terms and Conditions at any time.
ShopMundo shall have the right to enforce the provisions of these Terms of Use even if there has been no prior request made to you for such compliance.
APPLICATION AND ACCEPTANCE OF THE TERMS OF USE
Record
To use the Services, you must complete the Registration process by providing us with:
- Your name
- Identity Document Number (ID or passport)
- Birthdate
- Current address
- Phone number
- Email address
- Valid payment method associated with said account
- Any other information necessary to facilitate the service.
Each person who has completed an online registration form on the Website is a registered user of ShopMundo. We will therefore establish an individual account for each registered user who will be assigned a username and password to log in and gain access to his or her own Account.
All information you provide in connection with your registration must be true and you are solely responsible for keeping it up to date.
ShopMundo may refuse registration and deny the issuance of the Account, User Identification and Access Key if you do not comply with these Terms of Use or when the registration information cannot be verified, upon prior notification to you and in accordance with the current regulatory provisions.
The user will be responsible for maintaining the confidentiality of his/her account data and password and for restricting third-party contact with his/her computer and mobile devices.
The user will be responsible for the content of all messages communicated through the Account, as well as any consequences that this may entail.
Avacare may, upon notice to you, in accordance with applicable regulatory provisions, suspend or close the Account at any time if:
- Avacare determines that there is a breach of the Terms of Use by the Registered User.
- Avacare has reasonable grounds to suspect that such information provided by the User is false, inaccurate, outdated or incomplete.
- Avacare suspects that the account is being used for suspicious or illegal activities.
- Avacare believes that the Registered User's actions could cause financial harm or legal liability to themselves, others, the company or its affiliates.
Users
Users may use this site subject to compliance with the Terms and Conditions .
Avacare or its content providers grant you a limited, non-exclusive, non-transferable and non-sublicensable use of the website and the services offered for personal or internal purposes and not to use the platform and its content for your own commercial activities not authorized by the company.
Avacare reserves the right to limit, deny or create different access to the page and to modify or introduce functions in relation to its users, upon prior notification to you and in accordance with current regulatory provisions.
Accessibility
We strive to make our best efforts to provide Avacare services on a continuous and quality basis according to our technical capabilities.
Breakdowns caused by force majeure, repair or maintenance work in accordance with the technical parameters defined by current regulations will not entail liability on the part of Avacare beyond the regulatory provisions applicable to such services.
Intellectual Property Rights
Avacare is the sole owner or licensor of all rights in the website and its contents. All rights not claimed under these Terms and Conditions are reserved by this agreement.
Avacare.com websites, logos and related icons are trademarks of Avacare, SRL. Therefore, they are established in the corresponding jurisdictions and are protected under applicable copyright, trademark and property rights laws. The reproduction, copying, downloading, extraction or reuse, modification, use or publication of these marks is strictly prohibited and penalized.
You are not permitted to systematically copy, reproduce, download, extract or reuse any information or content, including:
- texts
- graphics
- logos
- button icons
- audio clips
- digital downloads
- images
- video clips
- directories
- files
- databases
- Listings available
...on or through the Website for marketing purposes and distribution via mass mailings, wireless or text messages, physical mail or otherwise. In addition to operating a business that competes with Avacare
Systematically searching Avacare content to create or compile, directly or indirectly, a collection, database or directory (whether through robots, spiders, automatic devices or manual processes) including our product listings and price lists without Avacare's written permission is prohibited.
Electronic Communications
Every time you use an Avacare service, send us an email, text message, or any other communication from your computer or mobile device, you are communicating with us electronically.
Likewise, Avacare may contact you through the aforementioned means or through any means of communication in relation to the use of the website and each service, for which you give your consent to such communications.
You agree that all agreements, notices, communications and communications that we send to you electronically satisfy any requirement that they be in writing, except where applicable law requires different communication.
CONDITIONS OF SALE
These Conditions of Sale apply to the purchase of products on the Avacare website.
Contract between buyers and sellers
When you make a purchase, we will send you a message confirming receipt of your order.
The contract that is generated once a purchase has been made concerns solely and exclusively the buyer and the seller of said product.
Avacare does not represent the third-party seller or the buyer, is not a party to that contract, and does not assume any responsibility related to the contract of purchase and sale of the products between both parties.
Avacare will assist the buyer with any claims and customer service issues after the product purchase has been made.
AVAILABILITY
Our Website includes information related to products for sale, however, ShopMundo does not directly control the availability of stock on the sellers' websites. When an order is processed, the user is informed by email. If any of the products included in the order are not available, no amount will be charged for that product.
SHIPPING AND DELIVERY
In some cases, it is not possible to confirm a specific delivery date when you place your order, so we will provide you with an estimate indicating a range of days.
Avacare will not be liable for any delay or failure by sellers or package delivery service providers.
CUSTOMS INFORMATION
When you place an order with Avacare for delivery to a country other than the seller's, you may be required to pay import taxes on the products, which will be collected when the package reaches its destination.
Customs clearance amounts and fees will be borne by the user.
Avacare does not control taxes and tariffs, which depend on the laws and regulations applicable in the country in which the product is received.
MINORS
Minors under 18 years of age may only use the website under the supervision of a parent or guardian, who must complete the purchase.
APPLICABLE LAW
Avacare's Terms and Conditions are established in accordance with the laws and statutes of the Dominican Republic, with the exception of Law 173 of April 6, 1966, on the Protection of Importing Agents of Merchandise and Products, and its amendments to date and the provisions on private international law.
Any dispute related to the services offered by Avacare or these Terms and Conditions may be adjudicated to the courts of the National District of the city of Santo Domingo, Dominican Republic and to the administrative bodies created for this purpose.
